Bamby Stone Terms and Conditions

Introduction
Welcome to the Bamby Stone website, operated by Vision Crew Pty Ltd, registered as Bamby Stone. Our business is located at Unit 6, 8 Technology Drive, Arundel QLD, Australia 4214, and accessible at www.bambystone.com.au. By accessing or using this website, placing an order, engaging in a consultation, or purchasing products or services from Bamby Stone, you agree to the following Terms and Conditions.
1. Agreement to Terms of Use
These Terms apply to all activities involving Bamby Stone. By using our Site or engaging with our products or services, you agree to these Terms. Bamby Stone may modify these Terms at any time without notice.
2. Content and Intellectual Property Rights
All content on the Site is owned or licensed by Bamby Stone and may not be copied or reproduced without prior written consent.
3. Your Use of the Site
You agree not to misuse the Site or attempt unauthorized access. Breaches may result in suspension or termination.
4. No Cooling-Off Period for Custom Products and Services
There is no cooling-off period for custom projects once production begins or installation is scheduled. By confirming a quote and making payment, you enter a binding contract. Cancellations are not permitted except at Bamby Stone’s discretion.
5. Refund Policy for Natural, Offcut, and Engineered Stone Products
Natural Stone: All sales are final and non-refundable due to natural variation and uniqueness.
Offcuts and Clearance Stock: Sold as-is, no returns or exchanges.
Engineered Stone: Refundable only if uncut, uncollected, and in original condition within 7 days, with a 20% restocking fee.
6. Payment Terms
Projects under 3 months: Full payment within 5 days.
Projects over 3 months: 50% deposit, balance due 1 month before installation.
Offcuts and natural slabs: Full upfront payment.
Late Payments: 10% once-off late fee plus 2.5% monthly interest on overdue amounts. All prices exclude GST.
7. Fees and Charges
Re-measurement Fee: $490 + GST
Rescheduling Fee: $220 + GST
Re-installation Fee: $1,000 + GST
Changes within 7 days of any scheduled visit will incur the applicable fee, even if no crew member attends the site.
8. Job Site Requirements and Customer Responsibilities
Customers must ensure the site is ready, safe, and accessible before any scheduled visit, provide aligned, fully installed cabinetry, ensure all appliances are on-site or clearly marked, be present or provide access on agreed dates, and ensure other trades are not working in the installation area during our allocated window. Failure to meet these requirements may result in delays, rescheduling fees, or cancellation of service.
8A. Removal of Personal Items & Valuables
Customers are required to remove all personal belongings, furniture, décor, appliances, and valuables from areas where Bamby Stone will be working prior to installation, delivery, or service commencement. Bamby Stone accepts no responsibility for damage, loss, or breakage of any item not removed from the work area. Any damage caused by the presence of such items will not be considered a defect or liability of Bamby Stone. If our crew must remove items to access the installation area, Bamby Stone will not be liable for any accidental damage or loss arising from such handling.
9. Slab Reduction Responsibility
If a customer requests fewer slabs than recommended, Bamby Stone is not responsible for design impacts including mismatched veining, bookmatching inconsistencies, or colour variation.
10. Production, Installation & Measurement
Accurate measurement depends on the job site being fully ready. Clients must review and confirm all final dimensions prior to production. Once installation is scheduled, no changes can be made without additional cost and delay. If the site is not ready, re-installation fees will apply.
Edge Profile Clearances: Customers selecting thicker edge profiles (such as 40mm+ apron or waterfall-style edges) must ensure that the builder or trade responsible for constructing the base has designed it to accommodate this thickness. This includes confirming that drawer or door operations are not obstructed by overhangs, returns, or apron drops. Bamby Stone is not responsible for interference or clearance issues resulting from insufficient base depth, misaligned structure, or poor planning by other trades.
10A. Join Placement
Unless otherwise specified in writing by the client prior to fabrication, Bamby Stone reserves the right to determine the placement of all joins and seams. Placement will be based on structural safety, slab characteristics, and overall visual alignment. Once production has commenced, changes to join placement cannot be requested.
11. Offcuts and Leftover Material Ownership
All offcuts remain the property of Bamby Stone unless agreed otherwise in writing. Requests to retain offcuts must be made before production ends. Unclaimed offcuts will be disposed of or reused after 7 days.
13. Warranty and Limitations
Natural stone variation such as veining or pitting is not considered a defect. No warranty applies to post-installation misuse, third-party damage, or wear and tear. Customers must inspect stone upon delivery or installation. No warranty is provided for stone supplied by the customer.
13A. Seam and Join Warranty: Bamby Stone warrants the workmanship of all seams and joins for a period of 12 months from the date of installation. This warranty covers installation-related defects only and excludes movement, misuse, or damage caused by other trades or external factors.
13B. Book-Matching Disclaimer: Natural stone slabs are unique and may include variation in colour, pattern, and veining. Book-matching is not guaranteed unless specifically requested and agreed upon in writing before fabrication. Bamby Stone will not be held responsible for mismatches in veining unless pre-approved book-matching arrangements have been made.
14. External Stone Slabs (Client-Supplied or Third-Party)
14A. Client-Supplied Stone: No warranty is offered for defects, cracks, scratches, or imperfections. Clients bear full responsibility for condition and suitability. Bamby Stone does not inspect or guarantee external slabs. A handling fee per slab applies in addition to other costs.
14B. Third-Party Stone (Sourced by Bamby Stone): Sourced upon client request; suitability not guaranteed. Warranties for man-made stone are offered by the manufacturer. Natural variation is not a defect. Freight and extended lead times may apply.
15. Acceptance of Goods & Services
Goods must be inspected upon delivery or installation. No claims are accepted after site departure unless covered by Australian Consumer Law. Delivery-only items must be inspected and any concerns raised within 3 days.
15A. Transport Insurance Disclaimer
Bamby Stone does not insure or guarantee goods against damage, cracks, scratches, or breakages during transport. Customers are strongly advised to arrange their own goods-in-transit insurance. Example: Express Insurance (www.expressinsurance.com.au) offers coverage for approx. $192.50 incl. GST for $27,500 worth of stone.
16. Shipping, Returns & Refunds (Products Only)
Flat-rate shipping available Australia-wide. ‘Authority to Leave’ applies for unattended deliveries. No refunds on custom, offcut, or natural stone products. Engineered stone must be unopened and returned within 7 days; 20% restocking fee applies.
17. Fire Compliance for Engineered Stone
Engineered stone is combustible. Customers are responsible for ensuring fire safety compliance near appliances or heat sources.
18. Health & Safety & Upper-Level Access
Standard installation applies to ground-floor access. If the site is deemed unsafe or has restricted access (e.g., stairs, cranes, hoists), additional handling or hire fees will apply. Charges are confirmed at the time of templating.
19. Unclaimed Products, Storage Fees & Ownership
If a customer fails to collect or accept delivery of goods within 60 days of readiness, a storage fee of $10.00 per day (excluding GST) will be charged. Storage fees must be paid before any release of goods. If the goods remain unclaimed for more than 6 months, they will be considered abandoned, and ownership will legally revert to Bamby Stone in accordance with the Disposal of Uncollected Goods Act 1967 (Qld). No refunds will be provided, and no further notice will be given. This clause applies to both pickup and delivery orders, and all customers agree to this condition by placing an order.
20. Termination
Contracts may be terminated due to non-payment, breach of terms, or site readiness issues. All unpaid fees become immediately payable.
21. Ownership of Drawings and Designs
All drawings, designs, and documents remain the intellectual property of Bamby Stone and may not be copied or used elsewhere.
22. Discontinued Materials
If a selected stone becomes unavailable, Bamby Stone will offer a similar alternative or a refund for that item.
23. Dispute Resolution
Disputes must be addressed first through direct negotiation, then mediation, then arbitration or QCAT if unresolved. Legal action is a final resort.
24. Limitation of Liability
Bamby Stone’s total liability is limited to the amount paid by the customer for the specific product or service in the prior 6 months. Bamby Stone will not be liable for indirect, special, or consequential loss.
25. Subcontractors
Bamby Stone may engage subcontractors as needed but remains accountable for their workmanship.
26. Customer Communication
Customers are responsible for providing accurate contact details and responding to communication to prevent delays or miscommunication.
27. Governing Law
These terms are governed by Queensland law. All parties agree to seek QCAT or mediation before legal action.
28. Feedback & Information
Any customer feedback submitted may be used internally by Bamby Stone and will be considered non-confidential.
29. Severability
If any clause of these Terms is deemed unenforceable, the rest of the document remains valid.
30. Entire Agreement
These Terms override any prior agreements or understandings between Bamby Stone and the customer.
31. Stone Ownership Until Installation Completion
All materials remain the property of Bamby Stone until installation is fully complete. If moved or altered before completion, Bamby Stone may withdraw from the project without refund.
32. Interference by Other Trades or Parties
If other trades are on-site during installation or prevent safe access, Bamby Stone may reschedule and charge a re-installation fee. Exclusive, safe access is mandatory during installation.
33. Natural Stone Cracks and Repairs
Hairline cracks due to natural veining are not considered defects. Bamby Stone will repair such cracks on-site where possible. Full replacements are only provided if damage is deemed unrepairable.
