Bamby Stone Terms and Conditions
Current Terms Version: 9 June 2026
INTRODUCTION
These Terms and Conditions apply to all products and services supplied by Vision Crew Pty Ltd trading as Bamby Stone, located at Unit 6, 8 Technology Drive, Arundel QLD 4214, Australia.
By accessing our website, approving a quote, placing an order, paying a deposit, confirming measurements, approving a final templating report, booking templating, booking installation, accepting delivery, or engaging our services, you agree to be bound by these Terms.
For existing orders, these Terms apply to future bookings, approvals, variations, production, delivery, installation, completion, and related project communications to the extent permitted by law and subject to any specific written terms already agreed by Bamby Stone.
Nothing in these Terms excludes, restricts, or modifies any rights, guarantees, remedies, or protections that cannot be excluded under the Australian Consumer Law.
1. AGREEMENT TO TERMS
These Terms govern all transactions with Bamby Stone. Bamby Stone reserves the right to amend these Terms at any time.
The version of the Terms published on the Bamby Stone website at the time of quote approval, order placement, payment, final templating confirmation, service booking, variation approval, or project approval will apply to the relevant transaction or project stage unless otherwise required by law.
2. INTELLECTUAL PROPERTY
All drawings, layouts, renderings, documentation, cutting diagrams, slab allocation tables, photography, website content, production files, project notes, forms, reports, workflows, templates, and digital systems remain the intellectual property of Bamby Stone unless expressly agreed otherwise in writing.
They may not be copied, reproduced, distributed, modified, reverse engineered, published, or used by any party without written consent from Bamby Stone.
3. NO COOLING-OFF PERIOD FOR CUSTOM WORKS
Once production has commenced or installation has been scheduled:
• Orders are binding
• Deposits are non-refundable
• Cancellations are not permitted
Custom stone fabrication, cutting, finishing, production, and project-specific preparation are manufactured or arranged to client specifications and cannot usually be resold.
This clause does not exclude, restrict, or modify any non-excludable rights the client may have under the Australian Consumer Law.
4. PAYMENT TERMS
Projects under 3 months duration:
Full payment is due within 5 days unless otherwise agreed in writing.
Projects over 3 months duration:
A 50 percent deposit is required. The balance is due 1 month prior to installation unless otherwise agreed in writing.
Natural slabs and offcuts:
Full payment is required upfront unless otherwise agreed in writing.
Late payments may incur:
A 10 percent once-off late fee plus 2.5 percent monthly interest.
All prices exclude GST unless otherwise stated.
Bamby Stone may suspend works, production, delivery, installation, booking access, or project coordination if payment is not cleared.
5. MEASUREMENT AND TEMPLATING APPOINTMENTS
Measurement and templating appointments are scheduled in advance and labour is allocated specifically for each project.
Rescheduling Within 7 Days
If a client cancels or reschedules a confirmed measurement or templating appointment within 7 days, a Measurement Rescheduling Fee of $499 + GST may apply.
Site Not Ready at Time of Measurement
If Bamby Stone attends site and measurement cannot be completed accurately due to:
• Incomplete, moving, unlevel, unsupported, or misaligned cabinetry
• Appliances not on site or not positioned
• Appliance, sink, cooktop, tap, cut-out, or specification details not confirmed
• Structural instability
• Trade interference
• Restricted, unsafe, or unclear access
• Existing benchtops, materials, obstructions, or personal items not removed where required
• Required cabinet corrections not completed
• Any failure of site readiness
The visit may be deemed aborted due to client default.
• A Measurement Re-Attendance Fee of $499 + GST may apply
• A new appointment may not be scheduled until the fee is paid
• Any resulting delay may affect production and installation timing
These charges reflect labour allocation, travel, scheduling, and operational commitment and are not penalties.
5A. FINAL TEMPLATING, STANDARD OVERHANG, SPLASHBACK ALIGNMENT AND SITE TOLERANCES
Final templating is the final site measurement and confirmation stage before production. Once final templating has been completed and the final templating report, drawings, measurements, site notes, photos, appliance positions, cut-out details, overhangs, join locations, splashback positions, and project details have been approved, the order may proceed into production.
After approval, changes may not be possible. If Bamby Stone accepts a requested change after approval or after production has commenced, the client may be required to pay additional costs, revised invoices, re-measurement fees, re-production fees, labour costs, material costs, delay costs, and any other costs reasonably incurred.
Standard Overhang Rules
To maintain a consistent finish and reduce avoidable alignment disputes caused by cabinet movement, cabinet variation, site irregularities, or minor cabinetry misalignment, Bamby Stone applies standard overhang and alignment rules during final templating, production, and installation.
Unless otherwise approved by Bamby Stone in writing before production, the following standard overhang rules apply:
• Where a benchtop, vanity top, laundry top, desk top, fireplace hearth, table top, or similar stone surface has an exposed side or visible end that does not finish directly into a wall, cabinetry panel, or other fixed obstruction, Bamby Stone’s standard finish is a 10mm overhang.
• Where cabinetry has handleless drawers or doors that open from the top, the front edge will generally be finished flush to the drawer or door face, unless Bamby Stone determines another detail is required for the project.
• Where cabinetry has front handles, Bamby Stone’s standard front finish is a 10mm overhang.
• Larger island, breakfast bar, seating, waterfall, feature, or project-specific overhangs are treated separately and must be confirmed as part of the approved project scope.
The client acknowledges that Bamby Stone may apply these standard overhang rules without requiring further approval at the time of templating where Bamby Stone considers them necessary to achieve a consistent, practical, and visually suitable result.
Splashback Alignment
Where a benchtop area includes a splashback, stone splashback, wall cladding, upstand, or similar return piece, the splashback will generally finish in line with the finished benchtop edge position. This includes any standard overhang applied by Bamby Stone.
Unless agreed in writing before production, splashbacks are not required to finish flush with cabinetry carcasses, doors, drawer fronts, walls, or other site elements if the benchtop edge position has been set according to Bamby Stone’s standard measurement and finishing rules.
10mm Site, Measurement and Installation Tolerance
The client acknowledges that stone fabrication and installation are subject to site, measurement, manufacturing, wall, cabinetry, handling, and installation tolerances. Perfect alignment is not always possible because walls, cabinetry, floors, site structures, appliance positions, and surrounding surfaces are rarely perfectly straight, level, plumb, square, or stable.
Unless otherwise required by law, minor variation up to 10mm may occur in relation to visual alignment, finished edge position, overhang position, wall gaps, splashback alignment, join alignment, cabinet-to-stone alignment, site fit, and finished positioning. Such variation is considered an accepted construction and site tolerance where the product remains reasonably fit for its intended purpose.
This 10mm tolerance does not give Bamby Stone the right to ignore reasonable workmanship standards. It recognises normal site and construction limitations, especially where cabinetry, walls, floors, site structures, appliance positions, or third-party works are not perfectly aligned, level, plumb, square, complete, or stable.
Cabinetry, Walls and Third-Party Site Conditions
The client is responsible for ensuring cabinetry, walls, floors, supports, appliance spaces, and all surrounding surfaces are installed, fixed, level, aligned, structurally suitable, and ready before final templating and installation.
Bamby Stone is not responsible for visual issues, uneven gaps, inconsistent overhang appearance, alignment concerns, shadow lines, flushness concerns, or fit concerns caused by:
• Misaligned, uneven, moving, unsupported, or unlevel cabinetry
• Cabinet doors, drawers, panels, handles, or fillers not sitting consistently
• Walls, floors, corners, cabinetry, or surrounding structures being out of square, out of level, bowed, curved, twisted, or uneven
• Third-party works completed before or after templating
• Cabinetry or site movement after templating
• Client instructions to proceed despite site or cabinetry issues
• Site conditions that were hidden, incomplete, inaccurate, or not reasonably identifiable at the time of templating
Client-Requested Variations and Non-Standard Features
If a client requests a flush finish, reduced overhang, increased overhang, non-standard overhang, non-standard edge profile, non-standard splashback alignment, non-standard join location, unusual stone feature, special design detail, or another variation to Bamby Stone’s standard measurement, production, installation, or finishing rules, the request must be reviewed and approved by Bamby Stone in writing before production.
Bamby Stone may decline any requested variation or non-standard feature that creates visual, installation, safety, structural, support, warranty, access, handling, production, or quality concerns.
If Bamby Stone agrees to proceed with a client-requested variation or non-standard feature, the client acknowledges and accepts that the variation may increase the risk of visual inconsistency, shadow lines, uneven appearance, overhang movement, insufficient support, cracking, chipping, bowing, vibration, alignment concerns, splashback alignment differences, join visibility, reduced durability, or other project-specific issues.
Where an issue arises because of the client’s requested variation, design instruction, site condition, cabinetry condition, support condition, appliance position, third-party work, or decision to proceed against Bamby Stone’s standard recommendation, the client accepts responsibility for that issue and any related cost, delay, rectification, rework, replacement, additional support, revised production, or further attendance required.
For larger overhangs, cantilevered stone, unsupported stone, special edge profiles, unusual shapes, or other high-risk features, the client may be required to arrange suitable cabinetry, brackets, steel support, engineering advice, builder confirmation, or other structural support before production or installation. Bamby Stone may refuse to proceed unless it is satisfied the requested detail can be produced and installed safely.
Bamby Stone remains responsible for workmanship performed by Bamby Stone within the approved scope. However, Bamby Stone is not responsible for the consequences of client-requested variations, non-standard features, unsuitable site conditions, insufficient support, or third-party works where those matters caused or contributed to the issue.
Final Templating Report Approval
When the client approves the final templating report, the client confirms that they have reviewed and accepted the final measurements, drawings, cut-outs, appliance positions, tap hole positions, sink and cooktop positions, edge details, overhangs, splashback alignment, joins, site notes, required actions, and project-specific details shown or referenced in the report.
Approval of the final templating report authorises Bamby Stone to proceed with production based on the approved details, subject to these Terms and Conditions.
6. INSTALLATION SCHEDULING, CANCELLATION AND SITE FAILURE
Installation dates are specifically allocated and labour, equipment, transport, and subcontractor resources are reserved in reliance on confirmed bookings.
Cancellation or Rescheduling Within 7 Days
If a client cancels or reschedules within 7 days of the confirmed installation date:
• 50 percent of the quoted Installation Fee may be charged.
If cancellation occurs within 48 hours:
• 100 percent of the quoted Installation Fee may be charged.
These charges represent a genuine pre-estimate of loss and operational commitment.
Site Not Ready or Installation Prevented After Attendance
If Bamby Stone attends site and installation cannot proceed or cannot be completed due to:
• Incomplete, moving, unsupported, unlevel, or misaligned cabinetry
• Structural inadequacy
• Other trades interfering
• Appliances not on site or not positioned
• Clearance issues
• Unsafe site conditions
• Restricted access
• Client-requested delay
• Obstructions, personal items, rubbish, or materials preventing safe work
• Any failure of site readiness
The installation may be deemed aborted due to client default.
• 100 percent of the quoted Installation Fee may become immediately payable
• A new installation booking may require payment of an additional Installation Fee
Where cranes, hoists, transport, accommodation, subcontractors, or special handling resources were pre-booked, those costs remain payable by the client.
These charges reflect actual operational commitment and are not penalties.
7. SITE REQUIREMENTS AND CLIENT RESPONSIBILITIES
Clients must ensure:
• Fully installed, fixed, level, aligned, and structurally suitable cabinetry
• Adequate structural support for stone weight
• Clear and safe access
• No trade interference
• Relevant appliances, sinks, cooktops, taps, and specifications are available or confirmed
• Compliance with Queensland WHS requirements and all relevant site safety obligations
Failure to meet these requirements may result in delay, re-attendance fees, rescheduling fees, additional labour, additional production costs, and other reasonable charges.
8. ADDITIONAL CLEARANCE AND OBSTRUCTION REQUIREMENTS
All areas where stone will be installed must be fully clear and unobstructed within the installation zone.
This includes but is not limited to:
• LED strip lights or aluminium lighting channels beneath overhead cabinets
• Rangehood covers, flues, or trims reducing clearance
• Powerpoints not recessed
• Decorative trims or protrusions
• Cabinetry components reducing safe clearance
• Tapware, basins, appliances, or fixtures obstructing safe installation
• Any item that prevents safe lifting, positioning, levelling, or fixing of stone
Cabinet doors are not required to be removed unless they prevent safe installation.
Bamby Stone does not remove or modify cabinetry, lighting, electrical components, plumbing, gas, appliances, glass splashbacks, wall finishes, or third-party fixtures unless expressly agreed in writing.
If obstruction prevents safe installation:
• Bamby Stone may stop work immediately
• 100 percent of the quoted Installation Fee may apply
• Rebooking may require a further Installation Fee
Bamby Stone accepts no liability where insufficient clearance exists or where third-party fixtures obstruct installation.
9. REMOVAL OF PERSONAL PROPERTY
Clients must remove all personal items, appliances, loose materials, valuables, fragile items, and obstructions from the work area prior to templating, delivery, or installation.
Bamby Stone is not liable for damage to items left within or near the work area or installation zone.
10. SLAB REDUCTION RESPONSIBILITY
If fewer slabs, panels, or stone pieces are selected than recommended by Bamby Stone, the client accepts responsibility for visual variation, pattern inconsistency, reduced layout flexibility, reduced book-match or vein-match potential, altered join placement, or reduced design outcome.
11. PRODUCTION, MEASUREMENT AND FABRICATION
Once fabrication begins, changes to layout, stone selection, overhangs, splashback alignment, join placement, cut-outs, appliance positions, tap hole positions, edge profiles, finish details, or any other production detail may incur additional cost and delay.
Bamby Stone may adjust final cut position, slab orientation, join position, and production method where reasonably required to suit slab condition, vein direction, material yield, safety, transport, handling, installation, or fabrication requirements.
12. JOIN PLACEMENT
Unless agreed in writing prior to fabrication, Bamby Stone determines seam and join placement based on structural, material, visual, handling, safety, production, transport, and installation considerations.
Join placement may vary from initial concepts, renders, or estimates where required for safe and practical production or installation.
13. APPLIANCE INSTALLATION AND ON-SITE MODIFICATIONS
Bamby Stone does not install appliances, mount sinks, reconnect plumbing, perform electrical works, perform gas works, or perform on-site cutting or drilling unless expressly agreed in writing.
All fabrication is completed in factory-controlled conditions where possible.
Any plumbing, electrical, gas, appliance, cabinetry, or third-party trade work remains the client’s responsibility unless expressly agreed otherwise in writing.
14. OFFCUTS OWNERSHIP
All offcuts remain the property of Bamby Stone unless agreed otherwise in writing prior to completion of production.
Offcut products may be limited in availability, sold as-is, and subject to specific conditions stated at the time of sale.
15. CABINETRY AND ADJACENT SURFACE COSMETIC MARKS
Stone installation may require manoeuvring heavy panels within tight tolerances between cabinetry panels, walls, floors, doors, and surrounding surfaces.
Minor cosmetic scuffs, pressure marks, or light surface marks may occur despite reasonable care, particularly where clearances are minimal, cabinetry is delicate, finishes are weak, or site access is restricted.
Where Bamby Stone is responsible for minor cosmetic marking that is reasonably repairable:
• The remedy is limited to touch-up, polishing, or local repair
• Replacement of doors or panels applies only if damage cannot reasonably be repaired to a consistent finish
The client must ensure cabinetry tolerances are appropriate and must provide matching touch-up paint, finish details, or repair materials where applicable.
Bamby Stone is not responsible for pre-existing marks, weak finishes, delamination, swelling, movement, poor cabinetry construction, or damage caused by other trades.
This clause does not exclude, restrict, or modify any non-excludable rights the client may have under the Australian Consumer Law.
16. WARRANTY AND LIMITATIONS
Natural stone characteristics including veining, pitting, fissures, pores, tonal movement, colour variation, crystal structure, fossilisation, surface movement, fill, resin, mesh backing, and naturally occurring irregularities are not defects.
Warranty excludes damage caused by:
• Structural movement
• Cabinetry movement or failure
• Site movement
• Third-party interference
• Misuse
• Impact, heat shock, staining, chemicals, or incorrect cleaning
• Post-installation modification
• Wear and tear
• Failure to maintain the product properly
• Failure to follow Bamby Stone care instructions
16A. Seam and Join Warranty
Seams and joins are warranted for 12 months against installation workmanship defects only.
This warranty does not cover movement caused by cabinetry, flooring, walls, building movement, structural movement, third-party works, misuse, impact, unsuitable site conditions, or post-installation modification.
16B. Book-Matching Disclaimer
Book-matching, vein-matching, colour continuity, pattern continuation, or visual alignment is not guaranteed unless agreed in writing prior to fabrication.
Even where book-matching or pattern matching is agreed, natural variation, slab availability, slab size, slab defects, cutting requirements, site constraints, join placement, and production limitations may affect the final result.
This clause does not exclude, restrict, or modify any non-excludable rights the client may have under the Australian Consumer Law.
17. CLIENT-SUPPLIED OR THIRD-PARTY STONE
Client-supplied stone carries no product warranty from Bamby Stone.
Third-party stone remains subject to the supplier or manufacturer warranty, where applicable.
The client accepts responsibility for the quality, suitability, consistency, availability, finish, thickness, strength, defects, cracks, breakage risk, transport risk, and performance of client-supplied or third-party stone.
Bamby Stone’s responsibility is limited to workmanship performed by Bamby Stone, subject to these Terms and the Australian Consumer Law.
18. INSTALLATION COMPLETION AND SIGN-OFF
Works must be inspected immediately upon completion while Bamby Stone’s crew remains on site, where reasonably possible.
Failure to raise visible or reasonably inspectable issues prior to crew departure may constitute acceptance of the visible completed works, subject to rights that cannot be excluded under the Australian Consumer Law.
Completion may be documented by photo evidence, video evidence, installation notes, customer/site contact comments, installation reports, or internal review records.
Latent defects remain protected under the Australian Consumer Law.
19. TRANSPORT INSURANCE
Bamby Stone does not insure goods during transport unless expressly agreed in writing.
Clients should arrange independent goods-in-transit insurance where required, especially for client-supplied stone, third-party stone, remote delivery, interstate transport, or high-value goods.
20. HEALTH, SAFETY AND RESTRICTED ACCESS
Additional charges may apply for upper-level installations, cranes, hoists, restricted access, difficult access, after-hours works, travel, accommodation, parking, permits, traffic control, special equipment, or additional labour required due to site conditions.
Bamby Stone may refuse, stop, or reschedule work where site conditions are unsafe or unsuitable.
21. UNCLAIMED GOODS AND STORAGE
If goods are not collected, accepted, installed, or otherwise progressed within 60 days of readiness, a storage fee of $10 per day excluding GST may apply.
After 6 months, goods may be deemed abandoned under the Disposal of Uncollected Goods Act 1967 (Qld). Ownership may revert to Bamby Stone and no refund will be provided, subject to any legal requirements that cannot be excluded.
22. DISPUTE RESOLUTION
The parties agree to attempt to resolve disputes by negotiation first.
If the dispute is not resolved by negotiation, the parties may attempt mediation before commencing proceedings, unless urgent relief is required.
If unresolved, disputes may be referred to QCAT or another court or tribunal with jurisdiction.
23. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Bamby Stone’s liability is limited to the amount paid for the relevant product or service within the previous 6 months.
Bamby Stone is not liable for indirect, consequential, special, economic, or loss-of-profit damages except where such liability cannot be excluded by law.
This clause does not exclude, restrict, or modify any non-excludable rights the client may have under the Australian Consumer Law.
24. SUBCONTRACTORS
Bamby Stone may engage subcontractors, contractors, delivery providers, installation support, transport providers, or specialist trades where required.
Bamby Stone remains responsible for workmanship performed under its direct scope, subject to these Terms and the Australian Consumer Law.
25. GOVERNING LAW
These Terms are governed by the laws of Queensland, Australia.
26. SEVERABILITY
If any clause or part of a clause is found to be invalid, unenforceable, or unlawful, the remaining clauses remain valid and enforceable to the maximum extent permitted by law.
27. ENTIRE AGREEMENT
These Terms, together with any approved quote, invoice, order record, final templating report, written variation, and written project-specific agreement, constitute the agreement between Bamby Stone and the client.
Any verbal discussion, informal message, or assumption does not override these Terms unless confirmed by Bamby Stone in writing.
